LIABILITY

ARK Sportswear does not accept liability for any loss or damages caused by this website, or any website linked to this website.

ORDERING METHOD

ARK Sportswear website offers on-line purchasing. Orders via phone, fax or email will also be accepted.

CURRENCY USED

The nominated currency used for all transactions is Australian Dollars (AUD$).

All prices displayed on the Australia website (www.arksportswear.com.au) will be in AUD$ and be inclusive of GST (Australian domestic Goods and Services Tax).

GST (Australian domestic Goods and Services Tax).

All Australian domestic customers and deliveries sent to Australian delivery addresses from the Australian Website will be subject to Australian GST.

The rate of Australian GST is 10%.

When Australian goods are exported (sent to a delivery address outside Australia) then the GST component of the price will be removed and the export price will be exclusive of GST.

SHIPPING RATES 

ARK Sportswear will publish or display the current shipping rates on the websites as applicable.

Shipping rates may vary or be waived as part of promotions or sales on the website and the part or fully discounted shipping may cease at any time at the discretion of ARK Sportswear.

ARK Sportswear reserves the right to change any or all of the following, at any time:

-Shipping rates charged to any destination;

-Delivery method;

-Carrier or shipping provider.

POSTAGE WITHIN AUSTRALIA

Online orders for delivery within Australia are normally dispatched via Australia Post or via Fastway couriers and orders are sent daily.

Standard Shipping rates of AUD$10 applies to all Australian deliveries of purchased goods of AUD$150 and under.

Standard Shipping is free for orders over AUD$150 in purchased goods when delivered to addresses within Australia.

Express postage within Australia $15 applies

SHIPPING TO NEW ZEALAND

Online orders for delivery to New Zealand are dispatched daily and arrival dates do vary dependant on shipping carrier used. Standard Shipping rates for delivery with New Zealand are:

A flat Shipping Rate of AUD$15 applies to all New Zealand deliveries AUD$150 of purchased goods and under.

Shipping is free for orders over AUD$150 in purchased goods when delivered to addresses within New Zealand.

ARK Sportswear does not accept any responsibility for customs delays, New Zealand duties or taxes that may apply; these will solely be the responsibility of the purchaser.

By confirming a purchase you are accepting responsibility for all Customs Charges incurred.  You will be importing goods into New Zealand. ARK SPortswear wishes to remind you that as the importer of goods you are legally responsible for any and all taxes, duties, and charges by the New Zealand Government.

INTERNATIONAL SHIPPING

ARK sportswear ships to most destinations around the world via DHL or Australia Post and Arrival dates do vary.  DHL are not able to deliver to PO Box addresses, when placing your order please provide a physical postal address.

ARK SPortswear does not accept any responsibility for customs delays, duties or taxes that may apply in the destination country.

International customers will need to check with their local customs office in regard to what, if any, duty you may be liable for when the order arrives.

The Standard Shipping Rate to all international destinations is a flat rate of AUD$25 per order.  Please note this is transport costs only and does not cover any import liabilities that may be applied by the Government of the destination country.

By confirming a purchase you are accepting responsibility for all Customs Charges incurred.  You will be importing goods into your destination country. ARK SPortswear wishes to remind you that as the importer of goods you are legally responsible for any and all taxes, duties, and charges by your Government.

ARK Sportswear does not have any control over customs charges and are unable to advise what they will be, as it is based on your own countries regulations & compliances.  If you are concerned about what charges you may be liable for, please check with your local customs office before proceeding to checkout.  All charges are to be paid by the customer on delivery of order.  Under no circumstance will ARK Sportswear accept any orders back due to rejection of customs charges.  Orders cannot be returned to sender.

DISPATCH OF ORDERS

Orders are normally dispatched within 1 business days of Order Confirmation subject to all ordered items being in stock.

If any items cannot be fulfilled from your order we will contact you via email or phone messaging.

ACCEPTANCE OF GOODS

On receiving the order the customer is responsible for inspecting the goods for fault or damage.

Should the items ordered not be of acceptable quality, it is the customer’s responsibility to notify ARK SPortswear, as soon as possible. Please see Returns & Exchanges Policy for more information.

PRICING

ARK sPortswear reserves the right to change prices without notice.

All prices and orders are displayed and processed in Australia Dollars (AUD) and will include Goods and Services Tax (10% GST) for all orders being delivered within Australia.

GIFT CARDS

ARK Sportswear may from time to time make Gift Cards available on the website.

Gift Cards are treated by ARK Sportswear as a financial instrument for payment for goods and services. ARK Sportswear Gift Cards do not contribute toward the calculation of shipping costs or discounts.

ARK sPortswear Gift Cards are not considered as goods or services with a retail price and therefore:

-They do not include GST;

-They cannot be discounted and are not subject to any discounts.

RETURNS OR EXCHANGES

Orders of full priced items placed online are eligible for exchange in store or online within 14 days of payment, given the tax invoice can be produced. Items must be returned in unworn, unwashed or otherwise unused condition, with original tags attached. If a garment(s) is deemed to have a manufacturing fault, a replacement, repair, gift card or refund will be issued.

To obtain an exchange online, the items must be returned within 14 days with proof of purchase.

To ensure the preferred item for exchange is held whilst the returning order is in transit, email cindy@arksportswear.com.au in advance with the below information. If the style you require is out of stock an online credit note or refund will be issued.

Refunds are offered on full priced items placed online within 14 days of payment, given the tax invoice can be produced. Items must be returned in unworn, unwashed or otherwise unused condition, with original tags attached. If a garment(s) is deemed to have a manufacturing fault, a replacement, repair, gift card or refund will be issued.

Items purchased on sale (permanently marked down items on sale) are not eligible for refunds; unless faulty, wrongly described or not of merchandisable quality.

ARK Sportswear reserves the right to determine whether a product is faulty and conduct a production and quality check. If deemed faulty by ARK Sportswear, a replacement item will be posted where possible subject to stock availability or a credit note issued. A response for Faulty Claims will be received within 48 hours of the garments arrival to head office.

PLEASE NOTE:

  1. a) Customers will be responsible for the return shipping and handling charge.
  2. b) ARK Sportswear will not be held responsible if there is a delay in delivery.
  3. c) If the product is deemed faulty after review we will then credit the cost of postage back to you.

For faulty or damaged goods, please include a copy of your postage receipt.

  1. d) You need to send the original or a copy of receipt with your order.
  2. e) In the event that your product is lost in transit, ARK Sportswear will not be held liable and therefore recommends that you send all returns via Registered Post.
  3. f) We ask that you allow 7 business days from the day you return your package for your account to be credited.

ORDER CANCELLATIONS

Please contact us at cindy@arksportswear.com.au immediately after placed order If you wish to cancel your order. Once order has been posted you will be liable for return postage and no refund on postage costs is available.

TYPOGRAPHICAL ERRORS

In the event that an item is listed at an incorrect price or with incorrect information, ARK Sportswear reserves the right to withdraw an item from sale.
